The Department of Health and Human Services (DHHS) is allowing more flexibility for sharing patient records relating to substance use disorders. Title 42 of the Code of Federal Regulations Part 2 was amended to relax patient consent standards so that a patient will be allowed to consent to disclosure to general categories of individuals or entities, instead of being named in the consent. This final rule will take effect on February 17, and compliance will require providers to update their health information technology systems, train staff, and update patient consent forms.
